CPRC makes recommendations on exceptions to mandatory costs budgeting

Following the consultation of Mr Justice Coulson, the Civil Procedure Rules Committee (CPRC) has made its recommendations regarding the exceptions to mandatory costs budgeting.

It seems that there was much disquiet as regards the unlimited nature of the exception for cases above £2m within Commercial Court, TCC, The Chancery Division and Mercantile Courts. Accordingly recommendations have been made to and accepted by the CPRC to apply a blanket exception to all cases above £10m with discretion to costs manage cases above this value.

It is expected that these changes will be included in the latest round of CPR updates in April 2014. These changes will hopefully assist in bringing more certainty to clients and solicitors in planning their litigation as well as bringing greater clarity in so far as what is exempt.
